The University Trial Court case contesting the eligibility of Colorado Robertson and Shannon Bates to serve as Student Government president and vice president may now go before the University Court.
Jeffrey Noel said he plans to appeal the case after University Trial Court judge Rob Dowie ruled in favor of Robertson’s co-counsel and dismissed the case.
Daniel Marsh represented Robertson and made a motion to dismiss the case citing Article VI, Section VI, clause two of the SG Constitution. Marsh, political science sophomore, argued a strict interpretation of the SG Constitution with regards to the filing of election complaints.
“The constitution clearly states 48 hours – it does not necessarily say school days,” Marsh said.
Noel, mass communication freshman, argued the purpose of today’s trial is not to contest the validity of the complaints, but to hear the content of the complaints.
“They were filed within 48 class hours of the announcement,” Noel said.
Dowie ruled the SG Constitution does not state class days. Before delivering his decision, Dowie said it is important to premise it.
” Student Government has failed miserably as far as legislation goes,” Dowie said. “I think the legislative branch has failed our student body.”
