City prosecutor Arthur Boudreaux said he is in no hurry to close Kevin Mulcahy’s 2006 case.The Baton Rouge Police Department issued Mulcahy a misdemeanor summons Sept. 15, 2006, when a University student claimed Mulcahy followed him to his apartment as he walked home. Mulcahy was arrested and accused of being a peeping Tom, Boudreaux said.Mulcahy, political science professor who is on paid administrative leave, was required to go through treatment and remain alcohol-free before a decision was made to move forward with the peeping Tom case.Boudreaux said the case remains open because of Mulcahy’s most recent incident when he was arrested on charges of unauthorized entering of an inhabited dwelling Sept. 4.Mulcahy’s lawyer, Drew Louviere, hopes the charges recently assigned to district court will be dropped, Boudreaux said.”I don’t anticipate accelerating the resolution of this [2006] case if there is any reasonable anticipation that the newer charges will not be pursued,” Boudreaux said. “I’m not in a hurry to close this file in any particular fashion.”Boudreaux said he is assured Mulcahy is continuing with the original conditions and staying alcohol-free despite his apparent lapse in September.During the aftermath of Hurricane Gustav, Mulcahy and English professor Eldon Birthwright were drinking outside Birthwright’s apartment when Mulcahy abruptly walked inside the apartment without Birthwright’s permission, according to a police affidavit.Birthwright contacted the Baton Rouge Police Department, and Mulcahy was arrested and booked into parish prison. Mulcahy was placed under an investigative probe by the University, and replacements have been hired to teach his classes for the remainder of the semester.
