A state judge ruled Monday that former Phi Delta Theta fraternity member Matthew Naquin, who was charged with negligent homicide in the 2017 alcohol-related hazing death of fraternity pledge Max Gruver, must give prosecutors the passcode to his cell phone.
The East Baton Rouge Parish District Attorney’s Office confiscated his phone in November 2017 through a court order but have not been able to access the phone’s contents because of the passcode.
John Lindon, Naquin’s attorney, argued the order would violate Naquin’s constituitional right against self-incrimination. 
Naquin is scheduled to stand trial July 8 for negligent homicide, which is punishable by up to five years in prison. 
Former fraternity members Ryan Isto and Patrick Forde pleaded no contest in September to misdemeanor hazing and agreed to testify at Naquin’s trial.
