The question of whether or not to legalize medicinal marijuana has reemerged as Governor Jindal stated that he would be open to its legalization.
Louisiana has already passed a law that allows doctors to proscribe medical marijuana. The 1991 law allowed marijuana to be used as a proscription for cancer patients and spastic quadriplegics.
The law was supposed to go into effect after regulations were set in place, but the regulations were never created, making it impossible to legally fill a proscription.
Medical marijuana is currently legal in twenty states, as well as the District of Columbia. But any who attempts to buy marijuana for a proscription can still be arrest for possession.
Louisiana has some of the harshest marijuana possession laws in the country. An offender could be sentenced to twenty years in prison for a third possession offense, even with no other crimes on record.
While Governor Jindal is open to medical marijuana, he has stated that he would continue to oppose legalization for recreation and other non-medical purposes.
