University employee, Michael Sykes, was arrested Friday on charges of a second degree sex offense.
WRAL reports that Dining and Catering Operations employee Sykes was arrested at 7:26 p.m. on Friday in Knightdale by the Wake County Sheriff’s Office. Sykes was arrested on charges of a second-degree sex offense, a felonious act. In addition, he was charged with a misdemeanor sex offense.
The 22-year old University employee is currently being held in the Wake County jail, pending a hearing. He was officially charged with section 14.25-5 of the North Carolina statute on criminal law.
According to the statute,
“A person is guilty of a sexual offense in the second degree if the person engages in a sexual act with another person:
(1) By force and against the will of the other person; or
(2) Who is mentally disabled, mentally incapacitated, or physically helpless, and the person performing the act knows or should reasonably know that the other person is mentally disabled, mentally incapacitated or physically helpless.”
The statute continues to say that any person who commits the offense defined in this section is automatically guilty of a Class C felony. This type of felony carries a penalty of up to $100,000, or imprisonment of up to 40 years, or both.
In addition, Sykes’ charge of a misdemeanor sex act involved “free text” according to the police report. The specific nature of the text is unknown, but its classification as a sex misdemeanor assures a crude, sexual tone.
As of now, the Wake County Sheriff’s Office said it was unable to provide details regarding Sykes’ charges. It did, however, say he would be making his first court appearance this week.
